Effective date: October 14, 2026 · Last updated: October 14, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Track Fleet Pro 1 LLC, a Delaware limited liability company ("Track Fleet Pro 1," "we," "us," or "our"), and govern your access to and use of the website at trackfleetpro1.com, the Track Fleet Pro 1 web application, our mobile applications (when available on Google Play and the Apple App Store), tracking links, and related services (together, the "Service").
Please read these Terms carefully. Our Privacy Policy explains how we handle personal information and is part of these Terms.
1. Acceptance of these Terms
1.1. By creating an account, checking the acceptance box, signing in with an access code, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.2. If you accept these Terms on behalf of a company or other organization (for example, a motor carrier or freight broker), you represent that you have authority to bind that organization, and "you" also refers to that organization (a "Customer").
1.3. Drivers must accept these Terms and give their own location consent in the app before their first shift.
1.4. Shippers and end customers who only open a tracking link or use the shipment lookup form (BOL # + tracking number) do not need an account. By using a tracking link, you agree to use it only as described in Section 9.
2. Who may use the Service (eligibility)
2.1. You must be at least 18 years old and able to enter into a binding contract.
2.2. The Service is intended for business use by motor carriers, freight brokers, their dispatchers and drivers, and their shippers and customers. It is not intended for personal, family, or household tracking.
2.3. The Service is currently available for accounts based in the United States (including Puerto Rico), the Dominican Republic, and Honduras. We may add or remove countries at any time. Registration is not accepted from countries that are not enabled.
2.4. You may not use the Service if you are barred from doing so under applicable law, including U.S. export-control and sanctions laws.
3. Accounts, verification, and approval
3.1. Company accounts. Carriers and brokers register by providing accurate company and contact information, including, for U.S. companies, a valid USDOT and/or MC number. You must confirm your email address. Registrations that are not confirmed within 7 days are deleted automatically.
3.2. Manual approval. Every company account is reviewed and must be approved by our administrator before it can track drivers. We may request additional information or documents (for example, a certificate of insurance, MC operating authority, or IRS Form W-9) and may reject or revoke approval at our discretion, including if information cannot be verified.
3.3. User roles. A Customer may add users with different roles (for example, company administrator, dispatcher, or broker user). The Customer is responsible for who it invites, for the permissions it gives them, and for removing access when a person leaves.
3.4. Driver access. Drivers are added by their Customer and sign in with a one-time access code (valid for 7 days, with limited attempts) or an email invitation. Drivers must not share their codes or credentials.
3.5. Security. You are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately at admin@trackfleetpro1.com if you suspect unauthorized access.
3.6. Accurate information. You must keep your account, company, vehicle, driver, and document information accurate and up to date.
4. Obligations of carriers and brokers (Customers)
If you are a Customer, you represent, warrant, and agree that:
4.1. Valid authority. Where required by law, you hold, and will maintain, valid USDOT/MC numbers, operating authority, registrations, insurance, and any licenses needed for your operations, and the documents you upload are genuine and current.
4.2. Driver notice and consent. You are responsible for (a) informing each driver you add to the Service, before tracking begins, that their device location will be collected during shifts they start, and how it will be used and shared; (b) giving any written notices and obtaining any acknowledgments or consents required by the laws that apply to you and your drivers (for example, employee electronic-monitoring notice laws in states such as New York, Connecticut, and Delaware, and the consent rules of Dominican Republic Law 172-13); and (c) having a lawful basis to provide us with each driver's personal information, including license, medical certificate, date of birth, emergency contact, and photos. The in-app driver consent screen helps but does not replace your own obligations.
4.3. Lawful use only. You will use the Service only to manage your own fleet operations and the loads you are legitimately involved in. You will not use the Service to track any person outside a work shift, without their knowledge, or for any unlawful, discriminatory, harassing, or stalking purpose.
4.4. End-customer data. You have the right to give us the names, emails, and phone numbers of your shippers or customers that you enter into trips, and you will only send tracking links to people who have a legitimate interest in the shipment.
4.5. Load sharing. When you share a load with a broker or other partner through the Service, you authorize us to show that partner the shared information described in our Privacy Policy (for example, load status, live location and ETA during the shift, BOL #, load chat, and the driver's most recent verification photo).
4.6. Your records. The Service is not your system of record. You remain responsible for keeping any records you must keep by law (for example, driver qualification files, hours-of-service records, and bills of lading), and for exporting data you need before it is deleted under our retention schedule or when your account closes.
5. Driver tracking: how it works
5.1. Location is collected only during a shift that the driver starts by pressing START in the app, and it stops when the driver ends the shift. Customers, dispatchers, and brokers cannot start, extend, reopen, or change the hours of a driver's shift. There is no "pause" option: to stop being tracked, the driver must end the shift.
5.2. During a shift, the app records high-accuracy GPS points (latitude, longitude, speed, heading, accuracy, and time), generally at most every 15 seconds when moving and at least once per minute. If location is turned off or the signal is lost, the app tries again and, after about 10 minutes without positions, an alert may be shown and emailed to the Customer and the end customer may see "location temporarily unavailable."
5.3. In exceptional situations, our administrator may stop tracking and close a shift; this action is logged and the driver is notified.
5.4. Web app. The current web app only sends location while it is open and active in the browser. Mobile apps. Our future mobile apps may need to collect location in the background (when the app is closed or not in use) during an active shift. If so, we will show a clear in-app notice and ask for the operating system's permission before collecting it.
6. Acceptable use
You agree not to:
(a) use the Service in violation of any law or third-party right, including privacy, monitoring, transportation, and consumer protection laws; (b) track or attempt to track any person without the notices and consents required by law, or outside the shift-based tracking the Service provides; (c) upload false, misleading, or fraudulent information or documents, or impersonate any person or company; (d) post ratings, reviews, or messages that are false, defamatory, harassing, discriminatory, obscene, or that disclose another person's private information; (e) access data you are not authorized to see, guess tracking numbers or BOL numbers, share access codes, or bypass rate limits or security controls; (f) scrape, crawl, copy, or bulk-download the Service or FMCSA data obtained through it, except as expressly allowed; (g) reverse engineer, decompile, or attempt to derive the source code of the Service, except where this restriction is prohibited by law; (h) introduce malware, interfere with the Service, or impose an unreasonable load on our infrastructure; (i) resell, sublicense, or provide the Service to third parties as a service bureau without our written permission; or (j) use the Service to build a competing product.
7. Price: free at launch; future changes
7.1. The Service is currently offered free of charge. We do not collect payment information.
7.2. We may introduce paid plans or fees in the future. We will give Customers at least 30 days' notice by email and in the app before any fee applies to them, and fees will only apply if you choose to continue using the paid features after that date.
7.3. While the Service is free, we may change, limit, or discontinue features, usage limits (for example, Broker Check lookups), or the Service as a whole, and we will try to give reasonable advance notice of material changes.
8. Data and ownership
8.1. Your data. As between you and us, the Customer owns the operational data it and its users submit to the Service, including vehicles, trips, driver records, documents, messages, and location history ("Customer Data"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Customer Data only as needed to provide, secure, and support the Service, to comply with law, and as described in our Privacy Policy.
8.2. Our role. For driver and end-customer personal information that Customers submit or generate through the Service, we act as a service provider / processor on the Customer's behalf and process it according to the Customer's instructions, these Terms, and our Privacy Policy. Each Customer is responsible, as the business / controller, for its own legal obligations to its drivers and customers.
8.3. No sale; no advertising. We do not sell personal information, do not share it for cross-context behavioral advertising, and do not use location data for advertising.
8.4. Aggregated data. We may create de-identified or aggregated data that does not identify any person or Customer (for example, overall service usage statistics) and use it to operate and improve the Service.
8.5. Our property. The Service, including software, design, text, logos, and the Safety Data Indicator methodology, is owned by Track Fleet Pro 1 LLC or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes. All rights not expressly granted are reserved.
8.6. User content and ratings. You keep ownership of messages, reviews, and responses you post. You grant us a non-exclusive license to host and display them within the Service and, for ratings and reviews of companies, publicly on Company Check, as described in Section 10A.5. Ratings and reviews are shown without revealing the author's name or contact details. We may hide or remove content that we believe violates these Terms; moderation actions are logged.
8.7. Feedback. If you send us suggestions, we may use them without any obligation to you.
8.8. Export and deletion. You may request an export or deletion of your data as described in our Privacy Policy. Data is kept and deleted according to the retention schedule in the Privacy Policy.
9. Tracking links and shipment lookup
9.1. Carriers can generate a tracking link for a shipment. A link is valid for 7 days unless revoked earlier. Shippers can also look up a shipment with its BOL # and tracking number; that session lasts 12 hours and only works while the load is active or up to 72 hours after delivery.
9.2. Tracking pages show shipment information such as reference, tracking number, status, origin and destination, pickup date, ETA, delivery, and the last known position only while the driver's shift is open and the trip is assigned or in transit. They do not show the driver's name, phone, photo, or route history. If a broker is on the load, the carrier's name and phone are hidden and the broker's contact is shown instead.
9.3. Anyone with a tracking link or valid BOL # and tracking number can view the shipment. Do not post or forward them to people who should not see the shipment. You may not use tracking pages to identify or follow a driver personally.
9.4. To protect drivers and prevent abuse, we record each shipper view (time, BOL # used, and a salted hash of the IP address — not the IP itself) and apply rate limits to failed lookups.
10. FMCSA data, Broker Check, Company Check, and Safety Data Indicator
10.1. For U.S. companies, the Service may display public information from the Federal Motor Carrier Safety Administration (FMCSA) and U.S. DOT open-data sources, a "Broker Check" lookup, the public Company Check lookup, and an informational Safety Data Indicator calculated by Track Fleet Pro 1 from that public data, with a monthly history.
10.2. This information is for reference only. The Safety Data Indicator is not an official FMCSA rating, safety rating, credit report, or recommendation to do or not do business with anyone. Public government data may be incomplete, delayed, or inaccurate, and our calculations may contain errors. You are solely responsible for your own due diligence, including verifying authority, insurance, and bonds directly with FMCSA and other official sources. Track Fleet Pro 1 is a private company. It is not affiliated with, endorsed by, or acting on behalf of FMCSA, the U.S. Department of Transportation, or any government agency. The Safety Data Indicator and community ratings are not FMCSA safety ratings and must not be presented as such.
10.3. Not a consumer report. Track Fleet Pro 1 is not a consumer reporting agency, and Company Check, Broker Check, the Safety Data Indicator, and community ratings are not consumer reports under the Fair Credit Reporting Act (FCRA). You may not use them, alone or combined with other information, as a factor in deciding any individual's eligibility for employment (including engaging an owner-operator as a driver), credit, insurance, housing, or any other purpose covered by the FCRA or similar laws. To screen drivers, use FCRA-compliant tools such as FMCSA's Pre-Employment Screening Program (PSP). You may not use this information as the sole basis for any decision.
10.4. Lookups are subject to usage limits (currently 30 per hour and 200 per day per company), which we may change. Company Check lookups are limited (currently 20 per 10 minutes and 150 per day per connection), and you may not scrape, bulk-download, or resell Company Check results.
10A. Community Reviews on Company Check
10A.1 Who these rules apply to. Company Check lets anyone look up a U.S. motor carrier or broker and, if they wish, submit a review ("Review") of that company. If you submit a Review, you agree to this Section 10A, to the Review Guidelines, and to the other parts of these Terms that apply to you, even if you do not have an account. You accept them by checking the box on the review form before you submit. If you do not agree, do not submit a Review.
10A.2 Eligibility. You must be at least 18 years old and able to enter into a binding agreement. If you submit a Review on behalf of a company, you confirm you are authorized to do so.
10A.3 Your promises. By submitting a Review, you promise that:
- (a) you are a real person and the name and contact details you give us are yours and accurate;
- (b) the Review describes your own, first-hand experience with the company reviewed, and you have correctly told us your relationship with it;
- (c) statements of fact in your Review are true to the best of your knowledge, and your opinions are honestly held;
- (d) you are not an owner, officer, manager, employee, or agent of the company reviewed, or an immediate relative (spouse, parent, child, or sibling) of one, and you are not reviewing a competitor of a business you are connected to, unless you had a genuine experience with that company and disclose the relationship in the form;
- (e) you have not received, been offered, or asked for any payment, discount, gift, or other benefit for writing the Review or for its content, and the Review is not written for or at the request of someone else in exchange for anything;
- (f) you have the right to submit the content and it does not infringe anyone's rights; and
- (g) you will tell us if any of the above stops being true.
10A.4 Prohibited content. Reviews must not contain:
- (a) false statements of fact, or content that is defamatory or that you know or suspect to be untrue;
- (b) harassment, threats, intimidation, or abusive, obscene, vulgar, or sexually explicit content;
- (c) content that is discriminatory with respect to race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age, or another intrinsic characteristic;
- (d) personal information of any individual (for example, names of drivers or employees, phone numbers, email addresses, home addresses, license plates, license numbers, or photos), including your own;
- (e) trade secrets or confidential or privileged business or financial information;
- (f) content unrelated to the company's transportation or brokerage services;
- (g) advertising, links, spam, or requests for payment, including offers to remove or change a Review in exchange for anything;
- (h) content created to manipulate ratings, including fake, duplicate, automated, or coordinated Reviews, or Reviews written by or for a competitor without a genuine experience; or
- (i) anything else that is unlawful or that encourages unlawful activity.
10A.5 License to publish. You keep ownership of your Review. You grant Track Fleet Pro 1 a non-exclusive, worldwide, royalty-free, transferable, and sublicensable (only to our service providers and successors) license to host, store, reproduce, display, publish, format, translate, and distribute your Review, and to include its star rating in aggregate ratings, on Company Check and anywhere the Service is offered, for as long as we display it and afterwards only as needed to keep records required by law or our Privacy Policy. We may show the Review with its date, your stated relationship to the company, and a label such as "Visitor" or "Signed-in Track Fleet Pro 1 user." We will not show your name or contact details. We do not edit the words of Reviews. We may translate them automatically, and we may show an excerpt only if it does not change the meaning. To the extent the law allows, you waive any moral rights that would prevent these uses.
10A.6 Moderation; no obligation to publish. We review Reviews before they are published. We may publish, decline, or remove a Review, or temporarily hide it during a review, if we reasonably believe it breaks this Section 10A or the Review Guidelines, is fake, or must be removed by law. We apply the same rules to positive and negative Reviews and do not decline Reviews because they are negative. We are not required to publish any Review, to keep it published, or to explain our decision except as described in the Review Guidelines. Our procedure for reports, removal, and appeals is in the Review Guidelines. Nothing in this Section is a promise that a specific Review will be removed or kept.
10A.7 Reviews are not our opinions. Reviews are the opinions of the people who write them, not of Track Fleet Pro 1. We do not verify every statement in a Review and do not endorse any Review, reviewer, or company. Aggregate ratings are calculated automatically from the stars in approved Reviews, as explained on the page.
10A.8 No payment for Reviews. We do not pay, reward, or offer anything for Reviews, and we do not accept payment from any company to publish, remove, hide, reorder, or change a Review or a rating. Companies may not offer incentives for Reviews on Company Check, may not ask only satisfied customers to review them, and may not use threats, intimidation, or groundless legal claims to prevent or remove a Review. Report any such conduct to reviews@trackfleetpro1.com.
10A.9 Your responsibility and indemnity. You are solely responsible for your Review. To the extent permitted by law, you will defend, indemnify, and hold harmless Track Fleet Pro 1 LLC and its members, managers, and service providers from claims, losses, damages, fines, and reasonable legal fees arising from your Review or your breach of this Section 10A. Sections 11 (Disclaimers) and 12 (Limitation of liability) apply to Company Check.
10A.10 Legal requests and your identity. We keep your name and contact details private. We may disclose them if required by a valid subpoena, court order, or other legal process, or if needed to protect someone's safety. Unless the law or the order prohibits it, we will try to notify you at the contact you gave us and wait at least 14 days before disclosing, so you can object or seek legal advice.
10A.11 Removing your Review. You may ask us to remove your Review at any time by writing to reviews@trackfleetpro1.com from the email or phone number you used. We will take it down within 5 business days. We keep your name and contact details for the period described in our Privacy Policy (Section 8) in case of a legal claim about the period when the Review was public.
10A.12 Reviews of Track Fleet Pro 1. Nothing in these Terms prohibits or penalizes anyone for posting an honest review of Track Fleet Pro 1 anywhere, and we do not claim ownership of reviews about us.
10A.13 Rules for companies on Company Check. A company that finds itself on Company Check may report a Review as described in the Review Guidelines. Reporting false information to us, or reporting in bad faith to remove truthful negative Reviews, breaks these Terms.
11. Disclaimers
11.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation, to the fullest extent permitted by law.
11.2. GPS and connectivity can fail. Location accuracy depends on the device, its settings, battery, the cellular network, satellites, and the environment. Positions may be delayed, missing, or inaccurate, and ETAs are estimates. Maps are provided by third parties.
11.3. Not for emergencies or safety-critical use. The Service is not an emergency, safety, theft-recovery, or dispatch-of-emergency-services system. In an emergency, call 911 (or the local emergency number).
11.4. Not an ELD or compliance system. Unless we expressly state otherwise in writing, the Service is not an electronic logging device (ELD) registered under FMCSA rules, does not record hours of service (HOS), and is not intended to satisfy any FMCSA, DOT, insurance, tax (e.g., IFTA), or other regulatory recordkeeping requirement. Document expiration alerts are reminders only; you remain responsible for compliance.
11.5. We do not transport freight, act as a carrier or broker, or guarantee the performance, identity, or reliability of any carrier, broker, driver, or shipper, including those found or rated through the Service.
11.6. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
12. Limitation of liability
12.1. TO THE FULLEST EXTENT PERMITTED BY LAW, TRACK FLEET PRO 1 LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR GOODWILL, LOST OR DAMAGED CARGO, DELAYS, DETENTION, DEMURRAGE, FINES, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY.
12.2. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
12.3. These limits apply to all theories of liability and even if a remedy fails of its essential purpose, but do not limit liability that cannot be limited under applicable law (for example, for fraud, gross negligence, or willful misconduct where the law does not allow it to be limited).
13. Indemnification
Customers will defend, indemnify, and hold harmless Track Fleet Pro 1 LLC and its members, managers, employees, and contractors from and against any claims, damages, losses, fines, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Customer's or its users' use of the Service; (b) the Customer's failure to give notices to or obtain consents from its drivers or customers, or other violation of privacy, monitoring, labor, or transportation laws; (c) Customer Data or content posted by the Customer or its users; or (d) the Customer's breach of these Terms. We will notify you of the claim, let you control the defense (we may participate with our own counsel), and reasonably cooperate at your expense.
14. Suspension and termination
14.1. By you. You may stop using the Service at any time. A Customer may close its account, and any user may request deletion of their account, as described in our Privacy Policy. Deletion requests are reviewed by our team but cannot be kept on hold or refused: a request not approved within 10 business days is carried out automatically.
14.2. By us. We may suspend or terminate your access, reject or revoke approval, or stop tracking, with or without notice, if we reasonably believe that you violated these Terms or the law, that your information cannot be verified, that your use creates risk to drivers, other users, or the Service, or if required by law. When reasonable, we will tell you why and give you a chance to fix the issue. We may also discontinue the Service as a whole with at least 30 days' notice.
14.3. Drivers. A Customer may deactivate a driver at any time. A driver whose required documents have expired may be paused and unable to start shifts until they are updated.
14.4. Effect. On termination, your right to use the Service ends. We will delete or de-identify data according to the Privacy Policy, except data we must keep by law or for security, fraud prevention, or dispute resolution. Sections 8, 10.2, 11, 12, 13, 15, 16, and 18 survive termination.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and, where applicable, by the U.S. Federal Arbitration Act. Nothing in these Terms removes any protection you have under mandatory laws of the country where you live that cannot be waived by contract.
16. Dispute resolution
16.1. Informal resolution first. Before filing any claim, you agree to contact us at admin@trackfleetpro1.com with a description of the dispute, and we will try in good faith to resolve it within 30 days.
16.2. Courts. If not resolved, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Either party may bring an individual claim in small-claims court if it qualifies.
16.3. Individual claims; jury waiver. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any class or representative proceeding, and each party waives the right to a jury trial.
16.4. Time limit. To the extent permitted by law, any claim must be filed within one (1) year after it arises.
16.5. Either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information or to stop unauthorized access.
17. Changes to these Terms
We may update these Terms. If a change is material, we will notify Customers by email and/or in the app at least 15 days before it takes effect (unless it is required sooner by law or for security), and drivers will be asked to accept the new version in the app. The "Last updated" date shows the current version. If you continue using the Service after the effective date, you accept the updated Terms; if you do not agree, stop using the Service and close your account.
18. General
18.1. Third-party services. The Service uses third-party services, including Google Maps. By using the maps in the Service, you agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. We are not responsible for third-party services.
18.2. App stores. If you download our app from the Apple App Store or Google Play, these Terms are between you and Track Fleet Pro 1 LLC, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to iOS apps and may enforce them against you. You must also comply with the applicable app store terms.
18.3. Entire agreement; order. These Terms, the Privacy Policy, and any data processing addendum or order form we sign with a Customer are the entire agreement. If a signed agreement conflicts with these Terms, the signed agreement controls.
18.4. Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
18.5. Severability; no waiver. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
18.6. Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including network, satellite, cloud-provider, or power outages.
18.7. Notices. We may send notices to the email on your account or through the Service. You may send notices to the addresses below.
18.8. Language. These Terms are available in English and Spanish. If there is a conflict, the English version controls, except where local law requires otherwise.
